Trespassers or squatters can cause considerable damage to a commercial property, affecting the property’s value, necessitating costly repair work, interfering with any tenants’ businesses and hampering the owner’s ability to lease the property to tenants.
Quick, decisive action is often required to remove trespassers from commercial property or the land surrounding it, such as the car park. This ensures possession of the property is regained before too much financial harm has been caused. In much rarer cases, it can avoid long-term legal consequences from occurring, such as occupiers of the land gaining legal rights through adverse possession. However, you should seek specialist legal support and advice before taking any action. This ensures you do not do anything which may compromise your own legal position.
At Luscombe Gray, we recognise how closely tied enforcement of your commercial property rights can be to your business interests. Through practical legal advice and expert representation, we will tenaciously enforce the rights of your business, achieving the best possible outcome, whilst keeping disruption to your commercial interests to a minimum.

Removing trespassers from commercial property
It is important that you seek legal advice as soon as you become aware of trespassers to ensure that correct action is taken. Drastic action which does not follow legal processes may expose you to risks of civil or criminal liability.
Trespassing on non-residential property is a civil law matter rather than a criminal one. This means that the police can rarely intervene to remove trespassers on commercial property. Usually it is only in circumstances where the police have seen trespassers commit a criminal offence that they can effect their removal.
It may be necessary to apply to court for a possession order. This is often a relatively quick process, and once you have a possession order, it can be enforced by bailiffs or high court enforcement officers, with police assistance if necessary.
